Terms Applicable To All Services
By using the Fab Girl Fitness services, you agree to be bound by the following terms and conditions. Fab Girl Fitness reserves the right to change the Terms and Conditions at any time without notice, and your continued use of Fab Girl Fitness’s Website http://www.fabgirlfit.com constitutes your consent to such changes.
1. DESCRIPTION OF SERVICES.
Fab Girl Fitness will provide an ongoing set of fitness services including personal training, small group training, group fitness classes, virtual personal training, virtual group fitness classes, general fitness coaching and online fitness training.
2. LIMITATIONS OF SCOPE.
Fab Girl Fitness will not be responsible for work that is beyond the scope of services set forth in the subscription plan in effect at the time Client initiates the service. Any changes to the scope of services will not be effective unless approved by both parties.
3. LINK.
Client hereby acknowledges and agrees that Fab Girl Fitness shall have the right to use the name of Client, for reference as a customer of Fab Girl Fitness services for referral and marketing purposes.
4. PAYMENT FOR SERVICES.
Set up fees for fitness services are paid in full unless otherwise organized and agreed upon by both parties prior to work commencing. Payment will be made by credit or debit card through Square for in person personal training, virtual personal training and online fitness programming and through Stripe for in person group fitness classes and virtual fitness classes.
5. WARRANTY.
Fab Girl Fitness shall provide its services and meet its obligations under this Agreement in a timely and professional manner, using knowledge and skills consistent with generally acceptable standards in Fab Girl Fitness’s industry, and will provide a standard of care based on commercially reasonable efforts. The services and all products provided as part of the services are provided “as is” and Fab Girl Fitness disclaims, and client waives, any warranties, express or implied, as to the merchantability, fitness for a particular use or purpose, title, non-infringement or any other warranty, condition, guaranty or representation related to the services.
6. RELEASE OF LIABILITY.
Programs given by Fab Girl Fitness or information that is pulled from this website by anyone may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. Those who enroll and subsequently participate in the programs or those who consume any of the material offered by Fab Girl Fitness do so is purely voluntary and in no way mandated by Fab Girl Fitness.
Those that participate in any program or consume material offered, release Fab Girl Fitness and its agents from any claims, demands, and causes of action as a result of voluntary participation and enrollment.
It is fully understood that if any injury results from the enrollment and subsequent participation in programs through Fab Girl Fitness, the participant releases liability from Fab Girl Fitness and its agents now or in the future for conditions that may be obtained. These conditions may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness that may incur, including death.
7. INDEMNIFICATION.
Subject to the provisions hereof, Client shall indemnify, defend and hold harmless from and against any and all amounts payable under any judgment, verdict, court order or settlement for third party claims brought against Fab Girl Fitness arising from products or services related to this Agreement. Conversely, Fab Girl Fitness shall indemnify, defend and hold harmless from and against any and all amounts payable under any judgment, verdict, court order or settlement for third party claims brought against Client arising from the gross negligence or intentional misconduct of Fab Girl Fitness.
